Information on the processing of personal data - Art. 13 - EU Regulation 679/2016
The above regulatory provisions regulate the confidentiality of personal data and impose a number of obligations on those who process information referring to other subjects. Among the obligations to be met is that of adequately informing the natural person to whom the data refer (Data Subject) about the use that is made of the relevant data so that consent to its processing is freely expressed and unequivocal.
Termomeccanica S.p.A. protects the privacy of visitors to its website WWW.TERMOMECCANICA.COM by taking the most appropriate measures to protect personal data in accordance with the provisions of the law.
The information concerns only the website WWW.TERMOMECCANICA.COM not also other websites reached by the user through links.
Data processing can be defined as lawful if at least one of the following conditions is met:
a) the data subject has consented to the processing of his or her personal data for one or more specific purposes;
b) the processing is necessary for the performance of a contract to which the data subject is party or the performance of pre-contractual measures taken at the request of the data subject;
c) the processing is necessary to comply with a legal obligation to which the data controller is subject;
d) the processing is necessary to safeguard the vital interests of the data subject or another person;
e) the processing is necessary for the performance of a task carried out in the public interest or in connection with the exercise of public powers of the data holder;
f) the processing is necessary for the pursuit of the legitimate interests of the data holder or a third party, provided that the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data do not override, particularly if the data subject is a minor.

b) Purpose of Processing and Legal Basis
ersonal data that the user wishes to disclose will be processed to enable the Holder to formulate an appropriate response or execute an assignment received.
With regard to personal data communicated for the purpose of proposing one's candidacy, including the sending of resumes, this data will be processed for the sole purpose of personnel selection at the Data Holder and at the group companies that will act as autonomous Data Holders. Group companies that may request a candidate profile corresponding to yours will be notified of the information you submit. In the event that you do not wish to disclose your personal information to other Data Holders excluding this one, we ask you to indicate this explicitly so that your right to confidentiality and limitation of the processing of your personal information is not affected.
The legal basis for the above processing operations are identified in Article 6(1)(b) of EU Regulation 679/2016.
c) Method of processing
Your personal data will be processed electronically and in paper format by individuals authorized to process them, who are constantly identified, appropriately instructed and made aware of the constraints imposed by the relevant regulations, with the use of security measures designed to ensure the confidentiality of the data subject whose data they refer to and to prevent undue access to third parties or unauthorized personnel.
d) Period of data storage
Data are retained for as long as is strictly necessary to fulfill the purpose for which they were collected, including fulfillment of legal and tax obligations arising, collection/payment operations, management of any service/product guarantees, and other rights. Personal data are deleted when they no longer serve the purposes for which they were collected, and there are no legal grounds for retention.
Personal data will also be deleted if the data subject withdraws specific consent.
e) Rights of the Data Subject
The Data Subject is hereby informed that he/she may request from the Data Holder:
- access to your personal data (art. 15 EU Regulation 679/2016)
- integration of data when they are changed (art. 16 EU Regulation 679/2016)
- rectification of data (art. 16 EU Regulation 679/2016)
- deletion or oblivion as appropriate (art. 17 EU Regulation 679/2016)
- limitation of processing because, e.g., some data are in excess with respect to the purposes to be fulfilled (art. 18 EU Regulation 679/2016)
- portability in the sense of transferring the data to another owner without any burden or expense to the data subject (art. 20 EU Regulation 679/2016)
- to object to the processing for legitimate reasons (art. 21 EU Regulation 679/2016)
- to revoke consent at any time without affecting the lawfulness of the processing based on the consent given before revocation (art. 7 par. 3 EU Regulation 679/2016)
- submit formal complaints to the Privacy Guarantor by following the procedures and directions published on the Authority's official website at WWW.GARANTEPRIVACY.IT (art. 51 EU Regulation 679/2016)
f) Disclosure of data outside the Holder's organization
Your data will not be shared and will not be transferred to third countries or international organizations.
The data may be processed by Authorized/Internal Managers (Employees, Collaborators) and/or External Resources, the updated list of individuals who may become aware of the data can be requested from the Data Holder;
The exercise of rights is not subject to any formal constraints and is free of charge.
You may exercise your rights at any time by sending a registered letter or PEC to the addresses indicated above
Personal data means any information relating to an identified or identifiable person ("data subject"); an identifiable person is one who can be identified, directly or indirectly, by reference in particular to an identifier such as a name, an identification number, location data, an online identifier, or to one or more characteristic features of his or her physical, physiological, genetic, mental, economic, cultural, or social identity;
